I ♡ Trademarks Conference RoundtablesClause for Alarm: Navigating the Strengths and Risks of Coexistence Agreements
Alt Legal Team | January 26, 2025
We’ll be making the most of our time during the lunch hour at the I ♡ Trademarks Conference by hosting small roundtable discussions on a variety of relevant topics. Each roundtable will have a host assigned to lead the discussion with pertinent questions, allowing you to share knowledge and resources and get to know your fellow conference attendees.
Roundtable Description
Trademark coexistence agreements can help avoid or resolve more protracted and costly disputes, such as oppositions, cancellations, or litigation, and they can be used to overcome a Trademark Office citation. While these agreements can offer immediate benefits appealing to clients, they should not be entered into lightly. In this interactive roundtable, Lindsey Utrata (Counsel, Latham & Watkins) will lead participants in a discussion of the advantages, drawbacks, and key considerations surrounding coexistence agreements. The discussion will include:
- Benefits of coexistence agreements
- Central aspects of a successful coexistence agreement
- Key risks to be aware of when negotiating and enforcing such agreements
- Essential terms for inclusion
- Distinctions and similarities between consent and coexistence agreements
