In High Demand: Crafting effective and creative demand letters

From Budweiser's town crier to Netflix's quick missive that sounded like it was written by the characters from Stranger Things, recent examples of creative demand letters have demonstrated that they can be both fun and effective. But they are also the starting point that may determine whether a claim is won or lost. A great demand letter may set up your client for the efficient resolution of their case. A poor one can do the opposite, and doom you and your client to years of needless litigation (or even public ridicule). In this session, IP and business litigation attorney Moish Peltz will provide examples of both effective and ineffective demand letters and guide you through the strategy of crafting a demand letter tactically targeted to accomplishing the task at hand. Topics will include:

  • Identifying the goal of a demand letter
  • Crafting a great demand letter aligned with those goals
  • Selecting the appropriate contents and tone
  • Using demand letters to resolve claims before litigation
  • Ensuring demand letters contribute to rather than undermine litigation
