We’ll be making the most of our time during the lunch hour at the I ♡ Trademarks Conference by hosting small roundtable discussions on a variety of relevant topics. Each roundtable will have a host assigned to lead the discussion with pertinent questions, allowing you to share knowledge and resources and get to know your fellow conference attendees.

Roundtable Description

Nontraditional trademarks—spanning scents, sounds, tastes, colors, and more—challenge the traditional notions of what can be protected. In this interactive roundtable, Alt Legal’s Lauren Amanda Adler will lead a deep dive into the types of nontraditional marks, the jurisdictions that recognize them, and the unique hurdles practitioners must clear to secure and enforce these registrations. Attendees will explore how functionality, distinctiveness, and evolving office practices affect nontraditional mark strategies worldwide. In particular, participants will discuss:

  • Identifying the five senses in trademark protection
  • Examining which jurisdictions accept different types of nontraditional marks
  • Navigating common obstacles to registrability, including the doctrine of functionality
  • Overcoming enforcement challenges when traditional search and monitoring methods fall short
